18. y\u00fczy\u0131la kadar iktidar tekelini elinde tutan soylular ve onlara destek olan rahipler, kendilerinin di\u011fer insanlardan \u00fcst\u00fcn olduklar\u0131na, hak ve h\u00fcrriyetlerden sadece kendilerinin yararlanmas\u0131 gerekti\u011fine inan\u0131yorlard\u0131. Bu inanc\u0131n y\u0131k\u0131lmas\u0131na kar\u015f\u0131 m\u00fccadele veren 18. y\u00fczy\u0131l d\u00fc\u015f\u00fcn\u00fcrleri ise insanlar\u0131n do\u011fu\u015ftan e\u015fit ve h\u00fcr oldu\u011funu s\u00f6yleyerek “h\u00fcrriyet” ve “e\u015fitlik” kavramlar\u0131na geni\u015f yer verdiler.<\/p>\n

“H\u00fcrriyet” ve “e\u015fitlik” din\u00ee nitelikli kavramlard\u0131r ve \u0130l\u00e2h\u00ee kitaplarda yer alm\u0131\u015ft\u0131r. Buna ra\u011fmen, l\u00e2ik e\u011filimi g\u00fc\u00e7l\u00fc olan 18. y\u00fczy\u0131l d\u00fc\u015f\u00fcn\u00fcrlerinin, “h\u00fcrriyet” ve “e\u015fitlik” i\u00e7in m\u00fccadele vermeleri bir \u00e7eli\u015fki de\u011fildir. \u00c7\u00fcnk\u00fc, s\u00f6zde dindar olan papazlar\u0131n y\u00fczy\u0131llarca tanr\u0131 ad\u0131na soylular\u0131n zulm\u00fcn\u00fc onaylamalar\u0131, hak ve h\u00fcrriyet m\u00fccadelesinde bayra\u011f\u0131n l\u00e2iklere ge\u00e7mesine neden olmu\u015ftur. Fakat 18. y\u00fczy\u0131l d\u00fc\u015f\u00fcn\u00fcrleri “h\u00fcrriyet” ve “e\u015fitlik” kavramlar\u0131n\u0131 kendi d\u00fcnya g\u00f6r\u00fc\u015flerine g\u00f6re yorumlam\u0131\u015flar ve bu kavramlara l\u00e2ik anlamlar y\u00fcklemi\u015flerdir.<\/p>\n

\u201c\u2018H\u00fcrriyet\u2019 Kapitalistlerin, \u2018E\u015fitlik\u2019 ise Sosyalistlerin savunma arac\u0131na d\u00f6n\u00fc\u015ft\u00fc\u201d<\/h4>\n

18. y\u00fczy\u0131l d\u00fc\u015f\u00fcn\u00fcrleri taraf\u0131ndan savunulan ve Frans\u0131z Devrimi ile hayata ge\u00e7irilen “e\u015fitlik kavram\u0131”, hi\u00e7 kimsenin do\u011fu\u015ftan getirdi\u011fi bir \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fcn olmad\u0131\u011f\u0131n\u0131, “h\u00fcrriyet kavram\u0131” ise toplumsal tabakalardan hi\u00e7birinin di\u011ferine h\u00fckmetme ayr\u0131cal\u0131\u011f\u0131na sahip olmad\u0131\u011f\u0131n\u0131 ifade ediyordu. Bat\u0131da kapitalizmin g\u00fc\u00e7lenmesi ve buna kar\u015f\u0131 \u00f6nlem olarak da sosyalizmin g\u00fcndeme gelmesiyle, “h\u00fcrriyet” daha \u00e7ok kapitalistlerin, “e\u015fitlik” ise sosyalistlerin kendilerini savunma arac\u0131na d\u00f6n\u00fc\u015ft\u00fc. Kapitalistler, insanlara en geni\u015f anlamda h\u00fcrriyetin sa\u011flanmas\u0131yla t\u00fcm di\u011fer h\u00fcrriyetlerin kazan\u0131laca\u011f\u0131n\u0131, sosyalistler ise e\u015fitli\u011fin sa\u011flanmas\u0131 ile h\u00fcrriyetlerin ger\u00e7ekle\u015fece\u011fini savundular.<\/p>\n

\u201cDevlet y\u00f6netiminde esas olan “adalet” tir\u201d<\/h4>\n

\u0130ki asr\u0131 a\u015fan “h\u00fcrriyet” ve “e\u015fitlik” m\u00fccadelesinde ne sosyalistlerin ne de kapitalistlerin vaat ettikleri hak ve h\u00fcrriyet ortam\u0131 ger\u00e7ekle\u015fti. Bu kavramlar\u0131 hayata ge\u00e7irenler, il\u00e2h! k\u00f6klerinden kopard\u0131lar ve tamamen nefsan\u00ee arzular\u0131na g\u00f6re yorumlad\u0131lar. B\u00f6yle olunca da adaletli bir y\u00f6netim ger\u00e7ekle\u015ftiremediler. Devlet y\u00f6netiminde esas olan “adalet” tir. Adalet, il\u00e2h\u0131 k\u00f6kenli ve evrensel niteli\u011fi olan ilkeler \u00fczerine kurulan hassas bir dengedir. Yine \u0130l\u00e2h\u00ee k\u00f6kenli “e\u015fitlik” ve “h\u00fcrriyet” \u00f6l\u00e7\u00fcleri “adalet”i ger\u00e7ekle\u015ftirmenin ara\u00e7lar\u0131ndan ba\u015fka bir \u015fey de\u011fildir. Dolay\u0131s\u0131yla “h\u00fcrriyet” ve “e\u015fitlik” ancak “adalet” ile birlikte ger\u00e7ek anlam\u0131na kavu\u015fmaktad\u0131r.
\n\u0130sl\u00e2m hukukunda g\u00fcvenceye al\u0131nan insan haklar\u0131 evrenseldir. Temel haklardan yararlanma bak\u0131m\u0131ndan insanlar aras\u0131nda herhangi bir fark g\u00f6sterilmemi\u015ftir. \u00c7\u00fcnk\u00fc:
