Yukar\u0131da da belirtti\u011fimiz gibi; Isl\u00e2m’da adaletin iki boyutu vard\u0131r. Esasen Yunan hakimleri de bu iki boyutlu adalet anlay\u0131\u015f\u0131n\u0131, M\u0131s\u0131r ve Filistin y\u00f6resinde ve “her kavme kendi diliyle peygamber g\u00f6nderildi\u011fine g\u00f6re”, kendi k\u00fclt\u00fcr \u00e7evrelerinde tebli\u011f edilen il\u00e2h\u00ee vahy’den, ll\u00e5hi hikmet’den iktibas ederek tebli\u011f etmi\u015flerdir. Kur’an-1 Ker\u00eem’de, e\u015fitlik adaleti “adl<\/a>” terimi ile, “istihkak, liyakat ve oran adaleti” ise “k\u0131st” terimi ile ifade edilir.<\/p>\n

\u0130nsan haklar\u0131 alan\u0131; e\u015fitlik adaleti alan\u0131d\u0131r. Dil, din, cins, irk ay\u0131r\u0131m\u0131 yap\u0131lmaks\u0131z\u0131n b\u00fct\u00fcn insanlar aras\u0131nda, insan haklar\u0131 a\u00e7\u0131s\u0131ndan, tam bir e\u015fitlik sa\u011flanmal\u0131d\u0131r (Huc\u00fbr\u00e2t, 13). \u0130sl\u00e2m \u015eeriati’nde, insan\u0131 “zek\u00e2 sahibi ve konu\u015fan davar” h\u00fckm\u00fcnde tutmak, Roma Hukuku ve di\u011fer Hukuk \u00e7evrelerinde oldu\u011fu gibi “k\u00f6lelik” kurumu yoktur. Bunun yerine, sava\u015f esirlerinin toplum i\u00e7inde bak\u0131m ve g\u00f6zetimlerini ve toplum ile b\u00fct\u00fcnle\u015fmelerini sa\u011flayan bir “koruyucu aile” kurumu kabul edilmi\u015ftir. \u00c2dil olan, kamu haklar\u0131ndan yoksul olmayan aile reisleri; Devlet g\u00f6zetimi alt\u0131nda, k\u00f6leleri aile i\u00e7ine kabul eder, yedi\u011finden yedirir, giydi\u011finden giydirir.<\/p>\n

“K\u00f6le” kad\u0131nlardan, kendi r\u0131zas\u0131 ve evlenme iradesi olmaks\u0131z\u0131n cins\u00ee istifade imk\u00e2ni yoktur, \u00e7\u00fcnk\u00fc her \u015feyden \u00f6nce “k\u00f6le kad\u0131n” diye bir \u015fey yoktur, “k\u00f6le erkek” de olmad\u0131\u011f\u0131 gibi! “Milket-i yem\u00e2n” terimi, “sa\u011f elinin m\u00fclk\u00fc” ve daha sonra da “m\u00fclkiyet hakk\u0131 konusu: mal” anlam\u0131nda de\u011fildir, “m\u00fclk”; Kur’an-i Kerim’de “egemenlik, iktidar, yetki” anlam\u0131na gelir. “Milket-i yem\u00e2n”; \u00d6zel Hukuk anlam\u0131nda m\u00fclkiyet hakk\u0131n\u0131 de\u011fil, \u201ckoruyucu aile reisi”nin g\u00f6zetim yetkisini ifade eder.<\/p>\n","protected":false},"excerpt":{"rendered":"
