“Irz ve namuslar\u0131n\u0131z da her t\u00fcrl\u00fc tecav\u00fczden korunmu\u015ftur.” ifadesi de ki\u015filerin \u0131rz ve namusunun muhterem ve dokunulmaz oldu\u011funu kesin \u00e7izgilerle belirlemektedir. Buna g\u00f6re ki\u015finin \u00f6zel hayat\u0131n\u0131n tecess\u00fcs\u00fc, gizli y\u00f6nlerinin ara\u015ft\u0131r\u0131lmas\u0131, \u00e2ile hayat\u0131 ile ilgili s\u0131rlar\u0131n if\u015f\u00e5 edilmesi haram ve yasakt\u0131r. Ki\u015finin harimi anlam\u0131na gelen “har\u00eem\u00fc’r-rac\u00fcl” diye bir terim vard\u0131r ki bu, hukuki anlamda bir insan\u0131n korumas\u0131, him\u00e2ye etmesi \u00fczerine v\u00e2cip olan \u015fey demektir. Ba\u015fka bir ifade ile ba\u015fkas\u0131n\u0131n, ki\u015fiye haks\u0131z yere tecav\u00fcz\u00fc halinde hukuk kurallar\u0131 \u00e7er\u00e7evesinde m\u00fcdahale edece\u011fi, savunaca\u011f\u0131 \u015feylerdir ki bunlar, dilimizde \u0131rz ve namus kelimeleri ile ifade edilirler.<\/p>\n

\u0130sl\u00e2m hukukuna g\u00f6re ki\u015finin can\u0131na, mal\u0131na, \u0131rz ve namusuna, aile efrad\u0131na yani harimine d\u0131\u015fardan haks\u0131z bir sald\u0131r\u0131 oldu\u011fu zaman onlar\u0131 koruma ve gerekirse sald\u0131r\u0131y\u0131 defetme yani me\u015fru m\u00fcdafaa hakk\u0131 tan\u0131nm\u0131\u015ft\u0131r. Bir hadiste Hz. Peygamber (s.a.v.): “Kim malini, can\u0131n\u0131, dinini, \u0131rz ve namusunu korumak i\u00e7in m\u00fccadele ederken \u00f6ld\u00fcr\u00fcl\u00fcrse o \u015fehittir” buyurmu\u015ftur. Allah Ras\u00fbl\u00fc, bu a\u00e7\u0131klamaya \u00e7al\u0131\u015ft\u0131\u011f\u0131m\u0131z; can, mal, \u0131rz ve namus gibi ki\u015finin do\u011frudan \u015fahs\u0131 ve ailesiyle ilgili \u015feylerin olduk\u00e7a \u00f6nemli oldu\u011funu g\u00f6stermek ve bunu vurgulamak amac\u0131yla, bu tarih\u00ee hutbesinin hemen ba\u015f\u0131nda buna yer vermi\u015f ve tebli\u011f etti\u011fine dair muhataplar\u0131ndan s\u00f6z alm\u0131\u015ft\u0131r.<\/p>\n

\u201cTefecilik gibi bir s\u00f6m\u00fcr\u00fc d\u00fczenini yasaklam\u0131\u015f\u201d<\/h4>\n

“F\u00e2izin her \u00e7e\u015fidi kald\u0131r\u0131lm\u0131\u015ft\u0131r, aya\u011f\u0131m\u0131n alt\u0131ndad\u0131r. L\u00e2kin borcunuzun asl\u0131n\u0131 vermek gerekir. Ne zulmediniz ne de zulme u\u011fray\u0131n\u0131z. Allah’\u0131n emriyle faizcilik art\u0131k yasakt\u0131r. Cahiliyetten kalma bu \u00e7irkin \u00e2detin her t\u00fcrl\u00fcs\u00fc aya\u011f\u0131m\u0131n alt\u0131ndad\u0131r” s\u00f6zleri yukar\u0131da a\u00e7\u0131klamaya \u00e7al\u0131\u015ft\u0131\u011f\u0131m\u0131z, m\u00fclkiyet hakk\u0131 ile mallar\u0131n dokunulmazl\u0131\u011f\u0131 ve haks\u0131z kazanc\u0131n yasak oldu\u011fu hususlar\u0131 ile do\u011frudan ilgilidir. Yani Hz. Peygamber, bu de\u011ferli s\u00f6zleriyle tefecilik gibi bir s\u00f6m\u00fcr\u00fc d\u00fczenini yasaklam\u0131\u015f ve ortadan kald\u0131rm\u0131\u015ft\u0131r.<\/p>\n

“Cahiliyet devrinde g\u00f6r\u00fclen kan davalar\u0131 da tamamen kald\u0131r\u0131lm\u0131\u015ft\u0131r” s\u00f6zleri de ki\u015fi dokunulmazl\u0131\u011f\u0131, ya\u015fama hakk\u0131, toplum d\u00fczeni ve sosyal g\u00fcvenle do\u011frudan ilgili olup, kan davalar\u0131n\u0131n kald\u0131r\u0131lmas\u0131yla, toplumu alt\u00fcst eden anar\u015fi \u00f6nlenmi\u015f, bunlar\u0131n yerine karde\u015flik ilkesi tesis edilmi\u015ftir. \u015euras\u0131 bir ger\u00e7ektir ki, bu emir ve yasaklar k\u00e2\u011f\u0131t \u00fczerinde kalmam\u0131\u015f, bizzat Hz.
