Kamuda \u00e7al\u0131\u015fan 458 bin 615 s\u00f6zle\u015fmeliye kadro verilmesini \u00f6ng\u00f6ren Devlet Memurlar\u0131 Kanunu ve Baz\u0131 Kanunlar ile 663 say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamede De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun, Resmi Gazete’de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girdi.<\/p>\n

ANKARA (\u0130GFA) – <\/strong>Kanuna g\u00f6re, Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131’n\u0131n ta\u015fra te\u015fkilat\u0131nda a\u00e7\u0131ktan vekil imam-hatip ve vekil m\u00fcezzin-kayy\u0131m olarak g\u00f6rev yapanlardan gerekli ko\u015fullar\u0131 ta\u015f\u0131yanlar, Ba\u015fkanl\u0131k\u00e7a ilan edilecek yerlerde g\u00f6revlendirilmek \u00fczere imam-hatip ve m\u00fcezzin-kayy\u0131m unvanl\u0131 memur kadrolar\u0131na atanabilecek.<\/p>\n

A\u00e7\u0131ktan vekil imam-hatip ve vekil m\u00fcezzin-kayy\u0131m olarak g\u00f6rev yapanlar\u0131n unvanl\u0131 memur kadrosuna atanmas\u0131 i\u00e7in d\u00fczenlemenin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren 30 g\u00fcn i\u00e7inde m\u00fcracaat etmesi, ge\u00e7erlili\u011fi devam eden Kamu Personeli Se\u00e7me S\u0131nav\u0131’ndan yeterli puan\u0131 almas\u0131, s\u00f6zl\u00fc veya uygulamal\u0131 s\u0131navda ba\u015far\u0131l\u0131 olmas\u0131 gerekecek.<\/p>\n

4 YIL NAK\u0130L YAPILAMAYACAK<\/strong><\/p>\n

Memur kadrolar\u0131na atananlar\u0131n 4 y\u0131l s\u00fcreyle ba\u015fka kamu kurum ve kurulu\u015flar\u0131na nakli yap\u0131lamayacak. Yabanc\u0131 uyruklular\u0131n, Milli E\u011fitim Bakanl\u0131\u011f\u0131nda norm kadro sonucu ortaya \u00e7\u0131kan \u00f6\u011fretmen ihtiyac\u0131n\u0131n kadrolu \u00f6\u011fretmen istihdam\u0131yla kapat\u0131lamamas\u0131 hallerinde \u00f6\u011fretmenlerin, hizmetine k\u0131smi zamanl\u0131 olarak ihtiya\u00e7 duyulacaklar\u0131n, Adli T\u0131p M\u00fcessesesi uzmanlar\u0131n\u0131n, devlet konservatuvarlar\u0131 sanat\u00e7\u0131 \u00f6\u011fretim \u00fcyelerinin, \u0130stanbul Belediyesi Konservatuvar\u0131 sanat\u00e7\u0131lar\u0131n\u0131n, d\u0131\u015f kurulu\u015flarda ve yurt d\u0131\u015f\u0131 te\u015fkilatlar\u0131nda belirli baz\u0131 hizmetlerde \u00e7al\u0131\u015ft\u0131r\u0131lacak personelin de zorunlu hallerde s\u00f6zle\u015fme ile istihdamlar\u0131 sa\u011flanabilecek.<\/p>\n

S\u00f6zle\u015fmeli personel se\u00e7iminde uygulanacak s\u0131nav ile istisnalar\u0131, bunlara \u00f6denebilecek \u00fccretlerin \u00fcst s\u0131n\u0131rlar\u0131 ile verilecek i\u015f sonu tazminat\u0131 miktar\u0131, kulland\u0131r\u0131lacak izinler, pozisyon unvan ve nitelikleri, s\u00f6zle\u015fme fesih halleri, pozisyonlar\u0131n iptali, istihdama dair hususlar ile yurt d\u0131\u015f\u0131 te\u015fkilatlar\u0131nda istihdam edilecek personel i\u00e7in ayr\u0131ca olmak \u00fczere s\u00f6zle\u015fme esas ve usuller Cumhurba\u015fkan\u0131 taraf\u0131ndan belirlenecek.<\/p>\n

Yurt d\u0131\u015f\u0131 te\u015fkilatlar\u0131nda bu f\u0131kra kapsam\u0131nda istihdam edilecek s\u00f6zle\u015fmeli personelin hizmet s\u00f6zle\u015fmesi s\u00fcreleri, zorunlu hallerde mali y\u0131lla s\u0131n\u0131rl\u0131 olma \u015fart\u0131 aranmaks\u0131z\u0131n Cumhurba\u015fkan\u0131nca belirlenecek.<\/p>\n

Bu \u015fekilde istihdam edilenler, hizmet s\u00f6zle\u015fmesi esaslar\u0131na ayk\u0131r\u0131 hareket etmesi nedeniyle kurumlar\u0131nca s\u00f6zle\u015fmelerinin feshedilmesi veya s\u00f6zle\u015fme d\u00f6nemi i\u00e7erisinde Cumhurba\u015fkan\u0131 karar\u0131 ile belirlenen istisnalar hari\u00e7 s\u00f6zle\u015fmeyi tek tarafl\u0131 feshetmeleri halinde fesih tarihinden, s\u00f6zle\u015fmeyi yenilememeleri halinde s\u00f6zle\u015fmenin bitiminden 1 y\u0131l ge\u00e7medik\u00e7e kurumlar\u0131n s\u00f6zle\u015fmeli personel pozisyonlar\u0131nda istihdam edilemeyecek.<\/p>\n

Devlet Memurlar\u0131 Kanunu’na tabi kamu idarelerinde Cumhurba\u015fkan\u0131nca belirlenecek pozisyon unvanlar\u0131nda \u00e7al\u0131\u015ft\u0131r\u0131lmak \u00fczere i\u015fin ge\u00e7ici olmas\u0131 \u015fart\u0131 aranmaks\u0131z\u0131n s\u00f6zle\u015fmeli personel istihdam edilebilecek. Bu kapsamda istihdam edilen s\u00f6zle\u015fmeli personelden ayn\u0131 kurumda 3 y\u0131ll\u0131k \u00e7al\u0131\u015fma s\u00fcresini tamamlayanlar, bu s\u00fcrenin bitiminden itibaren 30 g\u00fcn i\u00e7inde talepte bulunmalar\u0131 halinde bulunduklar\u0131 yerde ayn\u0131 unvanl\u0131 memur kadrolar\u0131na atacak.<\/p>\n

30 G\u00dcN \u0130\u00c7\u0130NDE BA\u015eVURU, 60 G\u00dcN \u0130\u00c7\u0130NDE ATAMA<\/strong><\/p>\n

Yasayla 1 y\u0131ldan az s\u00fcreli, ay\u0131n veya haftan\u0131n baz\u0131 g\u00fcnleri ya da g\u00fcn\u00fcn belirli saatleri gibi k\u0131smi zamanl\u0131 \u00e7al\u0131\u015fanlar ile y\u00fcksek\u00f6\u011fretim kurumlar\u0131n\u0131n ara\u015ft\u0131rma-geli\u015ftirme projelerinde proje s\u00fcreleriyle s\u0131n\u0131rl\u0131 olarak \u00e7al\u0131\u015fanlar hari\u00e7 olmak \u00fczere, Devlet Memurlar\u0131 Kanunu’nun 4B ve baz\u0131 kanun ve kanun h\u00fckm\u00fcnde kararnameler kapsam\u0131ndaki s\u00f6zle\u015fmeli personel ile mahalli idarelerde g\u00f6rev yapan s\u00f6zle\u015fmeli personelin, kanunun y\u00fcr\u00fcrl\u00fck tarihinden itibaren 30 g\u00fcn i\u00e7inde yaz\u0131l\u0131 olarak ba\u015fvurmalar\u0131 halinde memur kadrolar\u0131na atanmalar\u0131 ger\u00e7ekle\u015ftirilecek.<\/p>\n

Mahalli idarelerde kadroya ge\u00e7irilen personel, sadece mahalli idareler aras\u0131nda naklen atanabilecek.<\/p>\n

28 Kas\u0131m 2022’den \u00f6nce s\u00f6zle\u015fmeli personel kapsam\u0131nda \u00e7al\u0131\u015fanlar memur kadrosuna ge\u00e7ebilecek.<\/strong><\/p>\n

Devlet Memurlar\u0131 Kanunu’na g\u00f6re 4B kapsam\u0131nda s\u00f6zle\u015fmeli personel pozisyonlar\u0131nda \u00e7al\u0131\u015fanlardan baz\u0131lar\u0131 pozisyonlar\u0131n\u0131n vizeli oldu\u011fu te\u015fkilat ve birime, baz\u0131lar\u0131 ise Cumhurba\u015fkan\u0131nca belirlenen memur kadrolar\u0131na al\u0131nacak.<\/p>\n

\u0130l \u00f6zel idaresi, belediye ve ba\u011fl\u0131 kurulu\u015flar\u0131 ile mahalli idare birliklerinde \u00e7al\u0131\u015fan, genel \u015fartlar\u0131 ta\u015f\u0131yanlar s\u00f6zle\u015fmeli personel olarak \u00e7al\u0131\u015ft\u0131r\u0131lmalar\u0131na esas al\u0131nan memur kadrosuna ge\u00e7irilecek.<\/p>\n

Yaz\u0131l\u0131 olarak 30 g\u00fcn i\u00e7inde ba\u015fvurusunu yapanlar, bu madde y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren 60 g\u00fcn i\u00e7inde kurumlar\u0131nca atanacak.<\/p>\n

Kanuna g\u00f6re, 28 Kas\u0131m 2022’de askerlik, do\u011fum, evlat edinme, g\u00f6revlendirme, \u00fccretsiz izin gibi nedenlerle g\u00f6revlerinde bulunmayanlardan ilgili mevzuat\u0131na g\u00f6re yeniden hizmete al\u0131nma \u015fartlar\u0131n\u0131 kaybetmemi\u015f olanlar da d\u00fczenlemeden yararlanacak. Bu ki\u015filer i\u00e7in ba\u015fvuru ve atanmaya ili\u015fkin s\u00fcreler yeniden hizmete al\u0131nd\u0131klar\u0131 tarihten itibaren ba\u015flayacak.<\/p>\n
